Dear M.P. Fisher:

Thank you for your letter of January 11, 2024, regarding the proposed infill projects for pre-Confederation waterlots in Halifax Harbour, including waterlots in Dartmouth Cove.

Transport Canada continues to fulfill its responsibility as outlined and defined by the Canadian Navigable Waters Act (CNWA). Transport Canada is required to  review proposed works to ensure navigable waters remain open for transport and recreation. Departmental officials are currently reviewing the feedback received during the public comment period for the Dartmouth Cove infill project referenced in your letter. This feedback is taken into consideration when determining whether to issue an approval under the CNWA. We are also working closely with Fisheries and Oceans Canada (DFO) and consulting with Indigenous communities to review the proposed project. The proponent must obtain authorizations from both Transport Canada and DFO before any infill activity is able to proceed.

I understand that the Halifax Regional Municipality has passed amendments on their land-use bylaws to restrict water lot infilling on the Northwest Arm. If the Municipality chooses to pursue further changes or areas where these bylaws apply, they can continue to expect full cooperation from Transport Canada in any effort to avoid jurisdictional concerns.
